What is a County Court Judgement (CCJ)?

A County Court Judgement (CCJ) is a Court Order registered against your debtor whether it is for rental arrears or commercial debts. A Court Claim form will be issued to your debtor stating how much they owe and a deadline to settle any outstanding debt. If the CCJ is not settled, or ignored by the defendant it can be transferred to the High Court and a High Court Writ issued. This will then be enforced by High Court Enforcement Officers (HCEO).

Once you have been awarded a County Court Judgement (CCJ) and your debtor issued a County Court Claim to pay, an enforcement agency can begin the process of UK debt collection. 

To ensure payment you can work with a debt collection agency that provides CCJ Enforcement. Your CCJ must be transferred to a High Court Writ to be recovered on your behalf by High Court Enforcement Officers (HCEO). 

Enforcement of a CCJ

A number of debt recovery agencies will enforce a County Court Judgement (CCJ) for commercial or personal debts but they often have a minimum debt value of £600. They may also have requirements for how old the debt is, typically no older than 5 years. These trained and experienced officers will then work to recover your money as fast as possible.

County Court Judgement Enforcement Process

Debt Collection Companies with high recovery rates will begin enforcement as soon as possible. Your chosen agency will verify/confirm the County Court Judgement (CCJ). An additional fee of £71 is added to the CCJ and paid by the debtor. This fee is required for the transfer up to a High Court Writ of Control. This process can take 1-2 days.

The Cost to Enforce a CCJ

CCJ Enforcement fees should be clear and transparent. There will be a combination of ‘statutory enforcement fees’ that are required by the courts and agency fees. Agency fees should be confirmed as early as possible.
